Lamichhane sentenced to 8 years in prison

Kathmandu. Cricketer Sandeep Lamichhane, who was found guilty in the rape case, has been sentenced to eight years in prison by the Kathmandu District Court. In addition, the Kathmandu District Court ordered that Lamichhane should pay a fine and compensation of 5 lakhs to the victim. The bench of District Judge Shishirraj Dhakal found Lamichhane guilty in the rape case on the 13th of Paush. On Wednesday, the Dhaka court sentenced Lamichhane. Despite this decision, Lamichhane will be able to file a case against the district court's decision in the higher court. Although he was found guilty that day, Lamichhane was sentenced to pay. According to the information officer of the court, it was also decided that Lamichhane should pay a fine of three lakh rupees. The victim will have to pay a total of five lakh rupees as a fine of three lakh rupees and additional compensation of two lakh rupees. Lamichhane was charged with rape of a minor. The victim's age was determined to be “18 years old”. The court held that the age of the victim girl has reached 18 years from government documents obtained from various agencies. However, the court has mentioned in its judgment that his “delicate financial situation has been taken advantage of”. The final hearing in the said case started on the 8th of Paush and the verdict was given on the 13th. On Paush 13th, after the arguments of the lawyers of the Lamichhane side, the lawyers of the plaintiff side (changed name) Gaushala 26 (G) and the government lawyer also finished their arguments. Then the court decided. While pronouncing the verdict, the court stated that Lamichhane has committed an offense according to sub-sections 1, 2 and 3 (e) of section 219 of the Civil Code 2074. It is written in the said code — 1) No one shall force. 2) If someone commits sexual intercourse with a woman without her consent, or if he commits sexual intercourse with a girl under eighteen years of age, even with her consent, he shall be deemed to have committed sexual intercourse with such woman or girl. 3) In the sub-section, there is a provision to prescribe 'punishment based on the circumstances of the offense and the age of the woman'. In 3 (e), it is written that if a woman of 18 years of age or more than 18 years of age is forcibly raped, she will be punished with imprisonment from seven years to 10 years. Sandeep Lamichhane's IPL journey, India's famous professional cricket tournament, has now become like a 'fairy tale'. On October 20, Lamichhane was arrested at Tribhuvan Airport while returning from abroad. A case was registered against him in Kathmandu District Court on 14th November. On 28th Paush, Patan High Court ordered him to be released on a bond of 20 lakh rupees. After this, on February 16th, the Supreme Court granted permission to play cricket outside the country. After this he got to play in various national and international competitions. On 11 June 2080, the district court ordered to give treatment expenses to the victim Gaushala 26 as an interim relief. On the 13th of Paush, the bench of Judge Shishirraj Dhakal of the Kathmandu District Court ruled that Lamichhane had committed forced labor, and the decision to set a fine for punishment on the 25th of Paush was set. On the 25th of Paush, he was sentenced to 8 years in prison. Lamichhane's career Lamichhane also played in the world famous franchise league IPL. He played three seasons for Delhi Capitals in the IPL from 2018 to 2020 and took 13 wickets. He is the only Nepali cricketer to play in IPL in India. Similarly, he also played in Big Bash in Australia, Caribbean Premier League in West Indies. He was playing in the Caribbean Premier League when the allegations were made. He has taken more than 100 wickets in white ball matches for Nepal.
